Arpaio Thwarted In Jail Health Care Suit
A Maricopa County judge recently dismissed a lawsuit Sheriff Joe Arpaio filed against the Board of Supervisors related to the jails' health care system:
Arpaio sued the county Board of Supervisors and county administrators last year, saying they mismanaged the agency. County Superior Court Judge Robert Oberbillig granted the county's motion to dismiss Monday. Arpaio said he plans to appeal the decision and take the fight to federal court.

According to the Phoenix New Times, the judge's move may have saved the county more than $100,000:
Oberbillig's ruling, which he announced to the parties involved after oral arguments this afternoon, was a "judgment on the pleadings" -- meaning the judge was able to toss out the suit without any information other than the sheriff's complaint and the county's response.

Which, of course, means less cost to us taxpayers. Yay!

That doesn't mean it wasn't a huge waste of money. The judge's quick decision, says Wade Swanson, the county's general counsel, means that legal fees will run to "tens of thousands of dollars instead of hundreds of thousands of dollars." But hey... considering what this stuff usually costs, we'll take it.

I've never been sued, thankfully. But if anyone ever does, I sure hope it's Joe Arpaio! Seems like most of his lawsuits end up in dismissal, or judgments against him.

I just couldn`t picture Arpaio with a nurses uniform on .......Hell ....the man really doesn`t know how to run a jail properly ....... you know what I mean ?? loss of accredation of the jail and 13 MILLION dollars paid out in lost lawsuits and more in the pipeline ....remember what was said about the lawsuits ????? "THERE IS A COST OF DOING BUSINESS " WASN`T THAT HIS SECOND IN COMMAND HENDERSHOT WHO SAID THAT ?????? quality law enforcement ......

And why is it that Hendershott controls a $250m budget, after two bankruptcies and a pending foreclose, and Joke backs him up in stonewalling an audit?

I sure would'nt trust corrupt government in Washington. They have destroyed life as we knew it, we have two more years of hell, but we can still stop as much as we can in the mean time.

Look around everyone. We have exported all of our midclass manufacturing jobs to foriegn countries for cheaper labor. Our government did nothing. Illegals are STILL coming across the border. Why??? They are still getting jobs, while we are losing ours. Again, government is doing little to nothing to stop it. Are all of you going to support the illegals when we no longer have a middle class? Are you going to go to the fast food places, hotels, and Walmarts where they are working and getting free government health care while we can't get health care for our own kids? One of my professors in college said we are becoming a nation of service occupation. When our kids no longer know how to grow crops, build or manufacture things, we will no longer be a nation, but a servant to other nations. Help Arpio and others to get our country back.

Hi Brad- if you live in Maricopa County you have just made the point that Arpaio isn't doing enough about any of this. In fact, the unemployment rate HERE was as recently as two months ago- HIGHER than the average in the USA!

And he keeps wasting the taxpayers money. And he's a publicity hound. And he treats hounds better than humans- it's been on the TV, Brad!

Brad- please allow me to add: I agree with you that the US has allowed lots of manufacturing and other (even better jobs) to go oversees to all sorts of places. I have seen it at first hand- having trained foreign workers to take my job. That didn't sit well with me. But that is a subject for another thread.

And more importantly, it doesn't mean that Joe Arpaio is doing a good job, or that he is an effective Sheriff- that's why he pays his Chief Deputy Hendershott well over twice his own salary. Nobody has even attempted to justify that disparity and the list is very very lengthy. Nope- what we all want is good, capable, affordable law enforcement. What we have is a self-serving egomaniac politician who tells people what they want to hear and comes up with one after another publicity stunt to fool the public into thinking he's tough on crime. Ordinarily that would be just a normal sort of annoyance, but this man has the authority to take away people's freedom and has abused it numerous times, and has allowed very shoddy practices that have resulted in the ultimate penalty, sometimes before the case has even been adjudicated. I am referring to the senseless deaths that have occurred in his jails, at the hands of his officers. That is not acceptable.

Brad, I have read every factual thing I can get my hands on about the job Arpaio is doing (or not), and have reached my own carefully reasoned conclusion that he really stinks as a Sheriff. But he's a very very effective politician.

Don't bother with the facts just dismiss. Judges are quick to support the Supervisors and rule against Joe. No trial, no in depth review of the case just dismiss. The corruption in the county is amazing. I wish someone in the media would be as tough on the Supervisors as they are on Joe.

"Don't bother with the facts just dismiss...." Well, I noticed that you didn't post a single fact to back up your assertion. Do you know whether the charges were dismissed "with prejudice"? Do you know what that means?

It's quite easy to repeat non-facts, because "everyone says" (that is, everyone you know or associate with). But proving your point is a different matter.

For many years now, the media has covered Joe's press conferences and "crime supression sweeps" and many other of his publicity stunts and I never heard a word of complaint about their coverage until now, when he's being investigated for possible criminal abuses. If there's a reasonable suspicion that he abused his authority (he has a badge, so he has a lot of authority over you and me whether we like it or not)- wouldn't you want it investigated?

What if it were another law enforcement agency that was facing these accusations- would you want them investigated? If they were, would you like to be informed of it. Well, that is all the media is doing, and I would have to say that it seems that they are doing it in a pretty even-handed manner. Do you have evidence to the contrary?

The biggest problem is when people don't associate/put two & two together & realize the start of bashing/thugging, which is more apparent since new agenda started with Washington, most are radical left community organizers/criminals. Sounds like the are destroying the very core of our country & doing it illegally in very many ways. I am not for giving criminals more rights, they have too many already. So. if you can see the method to Washington's madness, then you just might see Washington has alot to do with lies, abusing their powers on Joe & media so you can be persuaded to believe that their way is better for the criminals, not for the american citizens.

Shifting the blame isn't a new tactic in dealing with accusations of wrongdoing. We've seen quite a bit (but not nearly all) of the evidence to support charges of abuse of authority. Arpaio has lost numerous court cases stemming from mistreatment, and deaths of those in his custody- some who hadn't even had their day in court. Its about 50 times the rate at which other jails of similar size have paid out damages and penalties!

His jails have lost their accreditation multiple times (and the standards are not that high). Where does the buck stop when it comes to running the MCSO? Why does Arpaio pay Hendershott much more than twice his own salary? Nobody has even attempted to explain that- so who is really the most important leader at MCSO?

Shift the blame all you want on these blogs, but in court Arpaio will have to take responsibility for his performance. Unlike these blogs- he will have to present provable facts and not just opinion and innuendo.

Now- where's the evidence that the BOS is guilty, and of what? Why do the charges keep getting dismissed? Post provable facts and not conspiracy THEORIES.

You talk about transparency, and I agree that is important. Why then, does Arpaio's MCSO fail to keep adequate records, and even fail to report crime statistics in their jurisdiction to the FBI some years?

We've had this discussion over a dozen times, but nobody has defended him with facts or evidence, only name calling and accusations and bizarre (maybe delusional) conspiracy theories.

Wow that is a lot of generalized accusations! No specifics, and therefore the only conclusions that a logical person can reach is that all of these scathing generalizations have no basis. They also have nothing to do with the accusations against Joe Arpaio which are documented, and very specific. Those have sound bases.

I really didn't expect anyone who idolizes the current Sheriff to address the facts. If the facts were important to them they would, in all likelihood, not be so fervent in their support.

Sorry - I didn't mean to abandon you to the wolves. You're right in that I don't post much out here anymore. I have a problem with a format that allows the BS that has gone on.

That does not detract from the issues. Simms AKA Stomper AKA Anonymous keeps posting that same old dreary post over and over again. Even though I have told him more than once that the "Let's rock like we did on the other boards (meaning previous threads on KPHO) was ME, not YOU, he's too stupid to recognize the ignorance of his post. The fact that he keeps posting the same thing over and over, as Stomper and Anonymous, and then responding as Simms, well.... you just need to wonder about his mental health...

You're right. I usually do post news articles, facts and links. I haven't been around much, not because I don't have anything to say (although Joe's pedalvision isn't really a topic that I find "hot") but because I work in a business that is highly linked to April 15th and I'm just too busy to be out here much. Couple that with my displeasure that any Joe Blow can come out here and post as me - well, it's low on my priority list.

That being said, I have been in contact with a couple of people that have always been very, very close, if not "spot on" as to the time frame that things happen within MCSO. Word is that indictments will be coming by the end of this month. Given the odds on the posters that I am referring to being accurate, that might be the end of April or perhaps early May. I don't trade options on these posts. I just have been impressed with their reliability. I'd be very surprised if the indictments are MIA by mid to late May.

It baffles me why some of the less educated people here that are so pro-Joe don't understand the ramifications of Hendershott walking away from his $775,000 debt on his home. It's not that he COULD NOT pay it. It was that he chose NOT TO. That depresses values of homes in his area and leaves the bank holding the bag for his poor decisions. And yet, this is a man who has declared personal bankruptcy TWICE in the past AND is IN CHARGE of a $260 million budget for MCSO. THAT does not make me comfortable. And to that the fact that he's a double dipper, not illegal, but certainly 'questionable' --

I've been a bit quiet lately for a few reasons. I'm waiting for Stomper/Simms/Annonymous to post something to tear into him over, I'm waiting for a new County Attorney to see what I think about the possibility of the continuation of the "pocket pal" relationship between the MCSO and the MCAO, and lastly, I'm waiting for The Freak Shurf JoKKKe Arpaio to resign for that foolish run for Guvner.

Don't think that I've abandoned you to spread the truth on your own, Lawn Order!! I know that we have together turned at least a few Joe sheep to the truth. I might not be here 24/7 but I will still speak my mind on these blogs, regardless of the verbal vomit of Simms/Stomper/Anonymous and his incredible reappearing post. ROTFL!!

The DOJ began investigating Joseph M. Arpaio under the Bush administration. While you, like I, may not agree with our current Washington DC opinion on the best solution to the boarder problems, don't blame Obama for Arpaio's mis-deeds!!! This was going on long before he took the office of President.

Liz, thanks for your post. I am glad everything is okay. I figured that you had left this blog to the indoctrinated drones who lack critical thinking ability and/or are too lazy or incompetent to research the facts. I have considered that myself, as I seem to be repeating the same stuff over and over trying to see if the logic will finally get to the illogical. I also do it in hopes that casual browsers will become a little more educated and curious to know more than before they visited.

It has crossed my mind on many occasions, that even if nobody posted the real factual evidence about Arpaio's dismal job performance, even if nobody confronted these repeaters of far-out manifestos, and nobody posted to attempt to make them think about the utter silliness of their faith in the man- it might make no difference. The silliness of their posts requires no grown-up to expose it. For objective people, therefore, I have thought that they might do some research based on the vitriolic fallacies the Arpaio supporters post. How could a reasonable person then support Arpaio?

However- I don't know. I very much appreciate the encouragement though. And am glad you posted your views yet again, even though some dimwit thinks he's going to dupe people by trying to sound a little more reasonable when he posts as you, then repeating the same flawed logic and propaganda(and changing the subject) that they all do.

In any event, Arpaio will have his day in court, unlike so many who have died in his jails simply because they were accused. Someday there will be an end to his waste of badly needed tax money for his own pleasure.

P.S. I hate April 15th! But there are people that make it a little easier to deal with.

The amounnts that he's paid out in taxpayer funds are part of the public record, as are all of the other lawsuits and his deposition. He likes to talk on camera, and make a fool of himself and of those who keep electing him. Facts are facts. Deal with it.

The media can't try him, but the court will. He loves the media too- and uses it every time he can. Joe Arpaio is a politician. Get a clue.

And I have cited numerous sources, I don't know how fast your read, I can only imagine. But take your time to read my posts. I have been faulted for citing the conservative Goldwater Institute's report too. You can't have it both ways. Arpaio is going to be tried in court no matter what you'd like to believe. And he needs to take responsibility for HIS actions (and inaction in many cases), and not shift the blame as so many criminals do.

When did you complain about the liberal media when they were giving him a camera and microphone to promote his publicity stunts. I'd like to see that. Don't you think it's hypocritical to complain about the coverage now after all these years?

My husband and I have been to quite a few states these past years as retirees, everywhere we go and people find out that Arizona is our home state and we live in Maricopa County they say: "Oh, you guys have that Sherriff, we love him, that is the way law enforcement should be. If we ever want to get rid of him, send him to their county. We have never heard a negative word from any so called "conservative or liberal or independent" against the Sherriff. As always it is the silent majority that sit back and listen what is going on and saying nothing.

No health insurance, No car insurance, Most do not pay taxes, some live off our community resources, sucking the state our of what little funds we have left. Its time we put up or shut up.
